Terms of Service

The rules for accounts, loyalty activity, vendor participation, native app-store memberships, acceptable use, and account closure.

Effective date: August 29, 2026  |  Last updated: August 29, 2026

These Terms of Service ("Terms") are a binding agreement between you and InstaMore governing your access to and use of the InstaMore mobile app, instamore.com, vendor and administration portals, APIs, and related loyalty services (collectively, the "Services"). By creating an account, accepting these Terms in an onboarding flow, purchasing a membership, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility and authority

You must be legally capable of entering this agreement. If you are below the age of legal majority where you live, a parent or legal guardian must authorize your use where required. If you use the Services for a vendor or other organization, you represent that you have authority to bind it and that "you" includes that organization.

2. Accounts and verification

You must provide accurate, current information and keep your contact methods under your control. InstaMore supports passwordless email or phone one-time codes and may support Apple, Google, and Facebook sign-in. If a provider identity already belongs to an account, it may be used to sign in; otherwise, verified provider information may be used to begin registration and you may be asked to complete necessary profile and consent fields. Do not share one-time codes, scan tokens, refresh sessions, or account access.

A verified phone number may be required for security-sensitive loyalty participation, transaction notices, account ownership verification, or fraud prevention. Verification and transactional messages are not consent to marketing. Carrier messaging and data rates may apply. Optional two-factor authentication and device biometrics may provide additional protection but do not replace your responsibility to secure the underlying device, email, phone, and identity-provider accounts.

We may refuse, limit, suspend, or require reverification of access when information is inaccurate, a session appears compromised, a role is unauthorized, or use threatens the Services or another person.

3. Shopper service

Shoppers may browse public vendor listings, present signed QR or barcode credentials, record eligible visits or purchases through participating vendors, receive points or rewards, redeem qualifying benefits, manage notifications, and review account activity. A scan or displayed balance is not by itself a promise that a purchase, visit, point, reward, or redemption is valid; vendor confirmation, eligibility rules, anti-fraud checks, expiration, and transaction processing may apply.

Points, rewards, cashback labels, tiers, promotions, and similar loyalty benefits are promotional, have no cash value unless expressly required by law, are not transferable unless the applicable offer says otherwise, and cannot be sold or exchanged outside an authorized InstaMore flow. Benefits may expire or be corrected when issued in error, reversed with an underlying transaction, obtained through abuse, or changed consistently with an offer's disclosed terms.

4. Vendors and vendor staff

Vendor participation may require application review and approval. Vendors are responsible for the truth and legality of their public profile, locations, offers, promotions, pricing, tax treatment, goods and services, staff access, customer service, and fulfillment of valid benefits. Vendor owners must assign least-privilege staff permissions, promptly remove former staff, and ensure users do not access another vendor's data.

Authorized vendor staff may scan a customer's signed, expiring loyalty credential and receive only the information necessary to complete an authorized interaction. Vendors must not enumerate customers, retain scan tokens, profile customers for unrelated purposes, share customer information improperly, create fictitious visits or purchases, manipulate points, or bypass transaction safeguards. Vendor records and activity may be audited.

5. Look-around access and paid membership

Eligible newly registered shoppers may receive a limited five-day "Look Around" access period beginning when the account is created. It is not a paid subscription, does not require payment, does not automatically convert by itself, may be available only once per person or account, and may offer limited functionality. The app identifies which features are available during or after this period.

Where offered, the InstaMore annual digital membership is currently listed at USD $5.99 per year in the United States. The exact price, currency, tax, introductory eligibility, and benefits shown in Apple App Store or Google Play at purchase time control and may vary by region. A paid membership is an auto-renewing subscription unless the purchase screen states otherwise.

6. Apple App Store and Google Play billing

Digital memberships in the iOS app are purchased through Apple In-App Purchase/StoreKit. Digital memberships in the Android app are purchased through Google Play Billing. Payment is charged to your Apple ID or Google Play account after confirmation. Subscription renewal, cancellation, billing grace periods, refunds, and payment methods are administered by the applicable store under its terms.

Unless you cancel at least 24 hours before the current period ends, the store may automatically charge renewal for the next period at the price presented by the store. On iOS, manage or cancel at Apple subscription settings. On Android, manage or cancel at Google Play subscription settings. Deleting the app or your InstaMore account does not by itself cancel a store subscription. Cancel the store subscription before deleting your account if you do not want future renewal charges.

Restoring a purchase requires the same store account and successful store verification. If store data is delayed or unavailable, access may remain pending until verification succeeds.

7. Acceptable use

You must not: violate law or another person's rights; impersonate anyone; access an account, vendor, tenant, or customer record without authorization; guess or enumerate identifiers; copy, forge, tamper with, replay, or automate loyalty credentials; manipulate visits, spend, points, rewards, ratings, or subscriptions; interfere with security or rate limits; scrape or bulk harvest the Services; introduce malware; reverse engineer except where law expressly permits; use the Services to send spam or abusive content; or help another person do any of these things.

8. Permissions and communications

Some features require a permission you choose to grant, such as camera access for scanning or selecting an image and notifications for enabled alerts. Manual code entry remains available for OTP where supported. You may disable optional permissions, although the related feature may not function. We may send essential service, security, verification, transaction, subscription, policy, or support communications. Optional marketing communications require applicable consent and may be withdrawn.

9. Third-party services

The Services interoperate with Apple, Google, Facebook, Amazon Web Services, mapping services, communications providers, app stores, and participating vendors. Their products, content, availability, and independent practices are governed by their own terms and policies. InstaMore is not responsible for a third party's goods or services, but this does not limit obligations that cannot legally be excluded.

10. Intellectual property and license

InstaMore and its licensors own the Services, software, designs, documentation, trademarks, and other content except for vendor or user content and third-party materials. Subject to these Terms, InstaMore grants you a limited, personal, revocable, non-exclusive, non-transferable license to use the app and Services for their intended purpose. No ownership rights are transferred. Feedback may be used without restriction or compensation, provided we do not identify you publicly without permission.

Apple-required acknowledgement

If you obtained the app from Apple's App Store, these Terms are between you and InstaMore, not Apple. Apple has no obligation to provide maintenance or support. To the extent permitted by law, Apple has no warranty obligation for the app beyond any refund remedy provided by the App Store. Apple is not responsible for claims relating to the app, including product-liability, legal-compliance, consumer-protection, or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the app-license provisions after your acceptance.

11. Availability, changes, and beta features

We aim to provide reliable Services but do not promise uninterrupted or error-free operation. Features may be unavailable because of maintenance, device limitations, connectivity, provider outages, security response, or legal requirements. We may add, modify, suspend, or discontinue features. If a change materially affects a paid subscription, applicable store and consumer-law remedies remain available.

12. Suspension, termination, and account deletion

You may stop using the Services and request account deletion from the app's account/settings controls or follow our public account-deletion instructions. We may suspend or terminate access for material or repeated violation, fraud, security risk, legal requirement, vendor deactivation, or nonpayment, using reasonable notice when appropriate.

Account deletion is subject to the retention rules in our Privacy Policy and does not cancel a store subscription. Provisions that by nature should survive termination—including payment obligations, ownership, disclaimers, liability limits, dispute terms, and authorized retention—will survive.

13. Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available." InstaMore disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Vendor listings, offers, availability, and goods or services are supplied or fulfilled by independent vendors. InstaMore does not guarantee that every vendor will honor an invalid, expired, reversed, or ineligible benefit. Nothing in these Terms excludes warranties or rights that applicable consumer law does not allow us to exclude.

14. Limitation of liability

To the maximum extent permitted by law, InstaMore will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, goodwill, data, benefits, or opportunities arising from the Services. Any aggregate liability will be limited to the greater of the amount you paid InstaMore through the app stores for the Services during the twelve months before the claim or USD $50. These limits do not apply where prohibited or to liability that cannot legally be limited.

15. Indemnity

To the extent permitted by law, vendors and organizational users agree to defend and indemnify InstaMore against third-party claims arising from their unlawful content, offers, goods or services, staff conduct, misuse of customer data, or breach of these Terms. This section does not require a consumer to indemnify InstaMore where prohibited by applicable law.

16. Disputes and governing law

Before filing a formal claim, please contact [email protected] with enough information for us to investigate and attempt an informal resolution. These Terms are governed by the laws applicable to InstaMore's principal place of business, without regard to conflict-of-law rules, except that mandatory consumer protections and jurisdiction rights in your place of residence remain unaffected. Nothing in these Terms requires arbitration or waives a right that cannot validly be waived.

17. Changes to these Terms

We may revise these Terms to reflect service, legal, security, or operational changes. We will post an updated effective date and provide additional notice or request renewed acceptance when required. If you do not agree to a material update, you may stop using the Services and request account deletion, subject to outstanding store subscriptions and lawful retention.

18. General terms

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions remain effective. A delay in enforcement is not a waiver. You may not transfer these Terms without our consent; InstaMore may transfer them as part of a merger, reorganization, sale, or by operation of law. These Terms, the Privacy Policy, applicable offer rules, and purchase disclosures are the entire agreement concerning the Services, except for a separately signed vendor agreement.

19. Contact

Questions about these Terms, subscriptions, vendors, or the Services may be sent to [email protected] or submitted through the contact page.
